The Terms and Conditions stipulated bellow apply to each and every transaction between:

Hereinafter referred to as “User”

These Terms and Conditions aim to define the terms of distance sales between ATELIER ZINA DE PLAGNY and the User, from ordering services, through the payment and delivery. They cover all the steps necessary for placing the order and keep track of the order between the contracting parties.
The ordering from the User implies the full acceptance of the present sales Terms and Conditions. Present Terms and Conditions can be amended at any time by I.T.C. therefore the User will be subject to the policies and Terms and Conditions in force at the moment when he placed an Order on the website www.zinadeplagny.com.
By placing an order through the Website, the User warrants that he is at least 18 year-old and legally capable of entering into binding contracts.

 

Products

The products offered for sale by the Website www.zinadeplagny.com are those mentioned on the Website at the date at which the User consults such Website, within the limits of the available stock. The products that are proposed for sale have been described and presented with the utmost care. However, if ever there have been errors or omissions on the website, ATELIER ZINA DE PLAGNY could not be held for responsible. Photographs and texts illustrating the products on offer are not contractually binding.

 

Prices

Prices are presented in euros (€), French VAT at the date of the order is included but delivery costs and eventual customs duties remain the responsibility of the User unless otherwise stated or conditions. If the rate of VAT were to be changed, those changes could be passed on to the price of items without that internet user be informed in advance.
I.T.C. reserves the right to change the prices on the Website www.zinadeplagny.com at any time but the products will be charged on the basis of the rates in force when the Order was placed, subject to availability of the products.
Regarding Orders passed by Users asking for a delivery out of Europe, prices are presented in euros (€), French VAT at the date of the order, delivery costs and eventual customs duties are NOT included. The VAT corresponding to the country of delivery as well as delivery costs and customs duties are to be added and remain the responsibility of the User.

 

Order

Any order implies the express and irrevocable acceptance of the prices, descriptions, and Terms and Conditions stipulated on the Website at the moment when the Order is placed.
The customer declares to have acknowledged and accepted the present general terms of sale before placing his order. By validating his order, the User accepts unreservedly these General Conditions of sale.
The order is considered to be binding from the final acceptance click. An email is sent to the internet customer once the order has been entered. This email confirms that ATELIER ZINA DE PLAGNY has taken the customer’s order into account and that the merchandise is available.

 

Payment

The payment can be made online by credit card, or using the PayPal platform. We will add the invoice to the package when shipping the Order and the User will also be able to find it in the “My orders” section of his ATELIER ZINA DE PLAGNY User Account.
Payment can be carried out by Visa and MasterCard cards. The User’s card will only be charged for the items that were actually shipped.
Order analysis and bank card fraud :
I.T.C. reserves the right to verify the personal data supplied by the User and to take the measures deemed necessary (request for additional information or documents or cancellation of the order) in order to make sure that the person whose bank account is debited is the same one who placed the order and to avoid fraudulent use of credit card numbers.

All delivery to a non-personal destination such as a postbox, cyber-café or a store will be automatically denied if our services cannot prove the destination as valid.

According to the French Data Protection Act of January 6th, 1978, any User has at any time, a right of access, rectification and opposition to all of his personal data by writing a letter, with a proof of his identity, to the following address :

Delivery costs, time and conditions

Orders are shipped within 2 working days (unless otherwise specified like in the case of products that would be indicated as “available within 10 or more days” or “unavailable”) and then delivered within 1 to 2 working days via the Colissimo Service (For more information, please refer to La Poste Terms and Conditions) Except in cases of major forces, delivery time will be indicated within the limit of stocks available. I.T.C. shall always exercise its best efforts to deliver within the times quoted but does not guarantee delivery time and shall not be held for responsible for any delay occurring in the delivery.
I.T.C. reserves to right of selecting the carrier so we can guarantee the quality of our delivery services.
The products are delivered to the address specified by the User when he places the Order. The User is required to verify the condition of the packaging and merchandises and report any damage to the carrier via the delivery documents at the time of delivery.
Orders to Metropolitan France are shipped through La Poste’s Colissimo Service with a tracking number and require a signature upon receipt. Orders to the DOM/TOM (OM1 and OM2 zones) will be carried out by La Poste’s Colissimo Service with a tracking number. Orders to European countries will be carried by Colissimo service. Orders to other countries will also be carried out by Colissimo.

 

Exchanges and Returns Policy

If the User is not completely satisfied with the products sent by ATELIER ZINA DE PLAGNY he has 14 working days to return an item and obtain a refund or 60 working days to ask for an exchange after receipt of the order.
In case of defective or incorrect orders, the User can add the invoice for the return shipping costs to the package and those will be refunded by ATELIER ZINA DE PLAGNY
Beyond this period, the delivered products will be deemed as complying with the Order and accepted by the User and ATELIER ZINA DE PLAGNY reserves the right to refuse to exchange them, issue a credit note or refund.
The products must be returned unused, in their original packaging and accompanied by a copy of the delivery order and a note explaining the motive of the return to the following address : ATELIER ZINA DE PLAGNY , 7, rue Oscar Roty, 75015 PARIS. FRANCE
In the case of a cancelation from I.T.C as a result of a disruption of the supply, the User will be refund and receive a special offer code as a compensation for the inconvenience. The delivery costs will also be refunded if there were any.
Refund will be carried out within 20 working days from the reception of the returned items.

 

Intellectual Property Rights

All materials posted on the Website www.zinadeplagny.com, including all content that may be accessed through the Service ( text, pictures, sounds, data, as well as any related software), are protected by copyright or subject to other intellectual property laws and, as such, are the exclusive property of I.T.C.
If a User wishes to place a direct link to the Homepage of the Website www.zinadeplagny.com on his personal website, and for a non-commercial use only, he will have to request an authorization from I.T.C. beforehand.
However, any hypertext link to the Website www.zinadeplagny.com and using a technique such as framing or inline linking is strictly prohibited.
In any case, any link, even tacitly authorized, shall be removed if a request is formulated by I.T.C.

 

Liability

Whilst we attempt to provide high quality information and to ensure that this information is accurate, I.T.C. could not be held for responsible for any loss, damage or inconvenience which may be caused by any error or omission on the Website www.zinadeplagny.com.
Under no circumstances may I.T.C be held responsible for any direct or consequential loss arising from the use by the User of the Website or any other website which it is linking to.
The present Terms and Conditions shall apply for the duration of the time I.T.C.’s services are offered online.

 

Governing law and disputes

French Law shall govern the present General Terms, in all aspects. The competent court in the event of a dispute shall be that of the effective destination of the Order.
In the event that a dispute should arise from this contractual relationship, the parties agree to seek an amicable solution before initiating any legal action.
